By accessing or using TradeWorkstation ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

TradeWorkstation is a trading journal and analytics platform that helps traders track, analyze, and improve their trading performance. The Service includes features such as:

• Trade journaling and record-keeping
• Performance analytics and statistics
• AI-powered insights and coaching (via Google Gemini API)
• Strategy management and backtesting tools
• Account tracking and portfolio management

3. User Accounts

To use the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account
• Be at least 18 years old to use the Service

4. WHOOP Integration

The Service offers optional integration with WHOOP wearable devices to track your health and wellness metrics. By connecting your WHOOP account, you:

• Authorize us to access your WHOOP recovery, sleep, workout, cycle, and body measurement data
• Understand that we will store and process this health data to provide wellness insights
• Consent to the collection of biometric data including HRV, heart rate, sleep stages, and strain scores
• Agree to WHOOP's Terms of Service and Privacy Policy in addition to these Terms
• Acknowledge that health data will be used to generate correlations with your trading performance

Data Accuracy: Health metrics from WHOOP are provided "as is" from WHOOP's API. We do not guarantee the accuracy of biometric measurements and they should not be used for medical decisions.

You can disconnect your WHOOP account at any time from the Health settings. Disconnecting will stop future data syncing but will not automatically delete previously synced data. To request deletion of your WHOOP data, please contact support.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Violate any applicable laws or regulations
• Infringe on the rights of others
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service's operation
• Upload malicious code or content
• Use the Service to send spam or unsolicited messages
• Resell or redistribute the Service without authorization
• Use automated systems to access the Service (bots, scrapers, etc.)

6. User Content

You retain ownership of all content you submit to the Service (trades, journal entries, notes, etc.). By submitting content, you grant us a limited license to:

• Store and process your content to provide the Service
• Display your content back to you within the application
• Generate analytics and insights from your data for your personal use

We will never share your trading data with third parties or use it for purposes other than providing the Service to you.

7. AI Features Disclaimer

The AI-powered features in TradeWorkstation are provided for informational and educational purposes only. AI-generated content:

• Is not financial, investment, or trading advice
• May contain errors or inaccuracies
• Should not be relied upon as the sole basis for trading decisions
• Is generated by third-party AI models (Google Gemini) with their own limitations

Always conduct your own research and consult with qualified professionals before making trading or investment decisions.

8. Financial Disclaimer

Trading financial instruments involves substantial risk of loss. Past performance does not guarantee future results. The statistics, analytics, and insights provided by the Service are based on data you input and are intended to help you track and analyze your own trading activity. We do not provide investment advice, trading signals, or recommendations.

9. Subscription and Payments

Some features of the Service may require a paid subscription. By subscribing:

• You authorize us to charge your payment method on a recurring basis
• Subscriptions automatically renew unless cancelled before the renewal date
• Refunds are provided in accordance with our refund policy
• We may change pricing with notice to existing subscribers

10. Intellectual Property

The Service, including its design, features, code, and content (excluding user content), is owned by TradeWorkstation and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADEWORKSTATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR TRADING LOSSES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOU USE THE SERVICE AT YOUR OWN RISK.

13. Indemnification

You agree to indemnify and hold harmless TradeWorkstation, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time through the Settings page. Upon termination, your right to use the Service will cease immediately. You may request export of your data before termination.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TradeWorkstation operates, without regard to conflict of law principles.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through the Service. Your continued use after such notice constitutes acceptance of the updated Terms.
